Terms of Service

1. Acceptance of Terms
By accessing or using TayibEats ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. TayibEats reserves the right to update these terms at any time. Continued use after changes constitutes acceptance.
2. Eligibility
You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or guardian. By using TayibEats, you represent that you meet these requirements.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information during registration and to update it as needed. TayibEats may suspend or terminate accounts that violate these terms.
4. Ordering & Pickup
TayibEats is a pickup-only platform. When you place an order:
- You are placing an order directly with the restaurant, not with TayibEats.
- Menu items, prices, and availability are set by the restaurant and may change without notice.
- You are responsible for picking up your order at the restaurant within a reasonable time.
- Orders that are not picked up may be discarded by the restaurant at their discretion.
5. Payments
All payments are processed securely through Stripe. TayibEats does not store your payment card details. By placing an order, you authorize the charge for the total amount shown at checkout, including any applicable taxes and tips. All sales are final unless a refund is issued by the restaurant or TayibEats at their discretion.
6. Cancellations & Refunds
If you need to cancel an order, contact the restaurant directly as soon as possible. Refund eligibility depends on the order status and the restaurant's policy. TayibEats may facilitate refunds through Stripe but is not obligated to issue refunds for orders fulfilled by the restaurant.
7. Halal Certification
TayibEats displays halal certification badges based on documentation provided by the restaurants. While we verify submitted certificates, TayibEats does not independently audit kitchen practices. Restaurants are solely responsible for the halal integrity of their food. If you have concerns about a restaurant's halal compliance, please contact us.
8. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the Platform.
- Interfere with or disrupt the Platform's operation.
- Submit false or misleading information.
- Use automated tools to scrape or access the Platform without permission.
9. Intellectual Property
All content on TayibEats, including the name, logo, design, and software, is owned by TayibEats or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without written permission.
10. Disclaimer of Warranties
TayibEats is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or that any content is accurate or complete. Food quality, preparation, and safety are the sole responsibility of the restaurant.
11. Limitation of Liability
To the fullest extent permitted by law, TayibEats shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to food-related illness, lost orders, or payment disputes. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.
12. Termination
We may suspend or terminate your access to TayibEats at any time, with or without cause, and with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.
13. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New Jersey.
